Terms for using HeartHome

1. Acceptance of Terms

By creating an account or using HeartHome, you agree to these Terms of Service and the policies they incorporate, including the Privacy Policy.

2. Eligibility

You must meet the minimum age required by applicable law, or use the service through a parent or legal guardian where that is permitted. Registration information must be accurate.

3. Description of the Service

HeartHome is a family connection and wellness platform for voluntary emotional check-ins, family communication, reminders, and related features. HeartHome is not a healthcare provider, crisis monitoring service, or emergency response service.

4. Medical, wellness, and emergency disclaimer

Wellness platform

HeartHome supports family communication and emotional wellness through voluntary check-ins. It is not a medical device or healthcare service.

No medical advice

Information in HeartHome is for general wellness and communication. It is not medical advice and does not replace care from qualified healthcare professionals.

No mental health treatment

HeartHome does not diagnose, treat, counsel, or manage mental health conditions. For professional mental health care, consult a qualified provider.

Not an emergency service

Do not use HeartHome to request emergency assistance or to monitor another person's immediate safety. It is not a substitute for emergency services.

Notification limitations

Messages and notifications may be delayed or fail because of device settings, connectivity, third-party services, maintenance, or other factors. Delivery is not guaranteed.

Crisis situations

If you or someone else appears to be in immediate danger or in a medical or mental health emergency, contact local emergency services immediately. In the United States, the 988 Suicide & Crisis Lifeline may also be an appropriate resource.

Your responsibility

You remain responsible for your own health decisions and for how you use information shared through HeartHome.

Family expectations

A missing check-in or notification does not by itself mean there is an emergency. HeartHome is meant to make it easier to stay in touch, not to replace direct contact or emergency planning.

5. User accounts

You are responsible for keeping login credentials confidential, keeping account information accurate, and notifying HeartHome of unauthorized access.

6. Account deletion

You may delete your HeartHome account at any time in the app: Profile, then Settings, then Delete Account. Deleting the account does not cancel an active subscription. Manage subscriptions separately through the App Store or Google Play. Account deletion is permanent and cannot be undone.

7. License grant

HeartHome grants each authorized user a limited, personal, non-exclusive, non-transferable, revocable license to install and use the HeartHome application on compatible devices for personal, lawful use under these Terms.

Ownership

The application, software, source code, object code, graphics, branding, documentation, and related intellectual property remain the exclusive property of HeartHome or its licensors. This license is permission to use the software. It does not transfer ownership.

Permitted use

Use the application for its intended purpose: voluntary family communication and emotional wellness check-ins. Commercial exploitation without written permission is prohibited.

License restrictions

You may not copy, modify, reverse engineer, decompile, disassemble, redistribute, lease, sublicense, sell, or create derivative works from the application except where applicable law expressly allows it.

Updates

HeartHome may release updates, patches, bug fixes, or new versions. Some updates may be required to keep using certain features.

Third-party software

The application may include or interact with third-party software or services governed by their own license terms and privacy policies.

Export compliance

You agree to comply with applicable export control and sanctions laws when downloading or using the application.

8. Family Circle

The Primary User controls invitations, permissions, and removal of Family Circle members. Access to shared information depends on the permissions the Primary User selects.

9. User content

You retain ownership of content you create. By uploading content, you grant HeartHome a limited, non-exclusive license to host, store, process, transmit, and display that content only as reasonably necessary to operate, secure, and improve the Services.

10. Acceptable use

HeartHome is for lawful, personal family communication. Interact with others lawfully and respectfully. Do not misuse the Services, interfere with system security, upload unlawful or infringing content, impersonate others, harass other users, or attempt unauthorized access.

Prohibited conduct

You must not harass, threaten, bully, impersonate others, upload unlawful or infringing content, distribute malware, attempt unauthorized access, interfere with the Services, or use HeartHome to facilitate illegal activity.

Content and family respect

You are responsible for what you post or share. Content must not violate another person's privacy, intellectual property rights, or applicable laws. Respect others' privacy settings, consent choices, and communication preferences. Do not pressure others to disclose emotional information.

Reports, investigation, and enforcement

Report suspected misuse, harassment, security concerns, or inappropriate content through HeartHome support. We may review reports, investigate potential violations, and take action consistent with applicable law. That may include warnings, removing content, restricting features, or suspending or terminating accounts for serious or repeated violations. If an appeals process is offered, you may request review of certain enforcement decisions under the published procedures. HeartHome may cooperate with lawful government requests and may preserve information where required by law.

11. Subscriptions and billing

Some features may require a paid subscription. HeartHome may offer free and paid plans. Features, pricing, and availability may change and will be described in the application or on the website.

Billing and renewal

Subscriptions may be billed monthly, annually, or on another disclosed cycle, using the payment method you select or an app store account. Unless canceled before the end of the current billing period, subscriptions may renew automatically at the then-current price, subject to applicable law and platform rules.

Trials, price changes, and cancellation

HeartHome may offer promotional pricing or free trials. Unless otherwise disclosed, a subscription converts to a paid plan at the end of the promotional period if you do not cancel first. You will receive advance notice of material pricing changes when required by law or platform policies. Cancel recurring subscriptions through the HeartHome website, Apple App Store, Google Play, or the billing platform you used. Cancellation generally stops future renewals. It does not automatically refund prior charges unless required by law or expressly offered.

Refunds, failed payments, and taxes

Refund requests follow the billing platform used, applicable law, and any published HeartHome refund policy. Apple or Google purchases may be subject to those platforms' refund processes. If payment cannot be processed, HeartHome may retry the charge, suspend premium features, or cancel the subscription after any required notices. Applicable taxes may be added where required by law and will be shown during purchase. Keep payment information current. Out-of-date billing details may interrupt paid features.

Family plans

If HeartHome introduces family subscription plans, additional terms will describe eligibility, account ownership, billing responsibility, and participant limits.

12. Intellectual property

The HeartHome name, logos, software, source code, designs, graphics, documentation, and other proprietary materials are owned by HeartHome or its licensors and are protected by applicable intellectual property laws. Original HeartHome content is protected by copyright unless otherwise stated. You may not copy, reproduce, distribute, modify, or create derivative works except as permitted by law or written authorization. Do not use HeartHome trademarks, service marks, logos, or branding in a way that implies sponsorship or endorsement without prior written permission.

Third-party rights and infringement

Respect the copyrights, trademarks, privacy rights, and other intellectual property rights of third parties. Infringing content may be removed. To report alleged copyright or trademark infringement, include enough information to identify the protected work and the allegedly infringing material. HeartHome may investigate and may remove content, suspend accounts, or take other action consistent with applicable law. Requests to use HeartHome trademarks, logos, or proprietary materials should be submitted in writing.

14. Service availability

HeartHome aims to provide reliable service but does not guarantee uninterrupted or error-free operation. Maintenance, outages, or third-party failures may affect availability.

15. Website terms of use

By accessing the HeartHome website, you agree to these website terms and applicable laws. The site provides information about HeartHome, support resources, account access, subscription information, and other approved content. Use it only for lawful purposes and in a way that does not interfere with its operation or others' rights.

Prohibited activities

You may not attempt unauthorized access, scrape content without permission, introduce malware, disrupt services, misrepresent affiliation with HeartHome, or violate applicable laws.

Content, links, and accuracy

Website text, graphics, logos, software, images, videos, and other content are owned by HeartHome or its licensors unless otherwise indicated. The site may link to third-party websites or services. HeartHome is not responsible for those third parties' content or practices. We aim for accurate information but do not guarantee that all website content is complete, current, or error-free. Website content is general information. It is not medical, legal, financial, or professional advice. Use of the website is also governed by the Privacy Policy, including cookies and tracking. HeartHome may modify, suspend, or discontinue portions of the website without prior notice.

Website liability and changes

To the extent permitted by law, HeartHome is not liable for indirect, incidental, or consequential damages arising from use of the website. These website terms may be revised periodically. Continued use after changes take effect is acceptance of the updated terms.

16. Disclaimer of warranties

The Services are provided “as is” and “as available” to the fullest extent permitted by law. HeartHome disclaims warranties except where applicable law prohibits that disclaimer.

17. Limitation of liability

To the fullest extent permitted by law, HeartHome is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Services. Nothing in these Terms limits liability where that limitation is prohibited by law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold HeartHome harmless from claims arising from your misuse of the Services or your violation of these Terms.

19. Suspension and termination

HeartHome may suspend or terminate accounts for violations of these Terms, unlawful activity, security concerns, or other reasons described in applicable policies. The license in section 7 ends if you violate this agreement. After termination, stop using the application and delete installed copies where applicable.

20. Changes to the Service

HeartHome may modify, discontinue, or improve features. Material changes to these Terms will be communicated through the Services or website.

21. Governing law and dispute resolution

The governing law, venue, and any arbitration or other dispute procedures for these Terms have not been specified yet. This section will be updated when those details are set.
